Jury Hears TikTok Allegedly Owed Over $116M for Infringing ‘Stitch’ Trademark

Recently, a jury in California heard a case that TikTok allegedly owed over $116 million for infringing the trademark of a software called “Stitch.” The lawsuit was filed by Stitch Software, Inc., which claims that TikTok used its trademark without permission and caused confusion among consumers.

The lawsuit was filed in 2019 after Stitch Software, Inc. noticed that TikTok was using its trademark without permission. Stitch Software, Inc. argued that TikTok’s use of the trademark was causing confusion among consumers, as they believed that the two companies were affiliated. Stitch Software, Inc. also argued that TikTok’s use of the trademark was damaging its reputation and business.

At the trial, Stitch Software, Inc. presented evidence that TikTok had used the “Stitch” trademark in various ways, including in its own app store, on its website, and in promotional materials. The company also argued that TikTok had not taken any steps to make it clear to consumers that it was not affiliated with Stitch Software, Inc.

The jury found in favor of Stitch Software, Inc., ruling that TikTok had infringed on the company’s trademark and was liable for damages. The jury awarded Stitch Software, Inc. $116 million in damages, which is believed to be one of the largest awards ever given for a trademark infringement case.

This case serves as an important reminder to companies that they must take steps to protect their trademarks from being used without permission. Companies should also ensure that they are not creating confusion among consumers by using trademarks that are similar to those of other companies. If a company fails to do this, they may find themselves facing a costly lawsuit like TikTok did.
